Conservation Area Planning Controls and Measurement Standards

Case reference EIR2026/02250

Received 20 September 2026

Published 14 October 2026

Request

1. CONSERVATION AREA POLICY COMPLIANCE: The council's formal policy document, threshold guidance, or operational framework regarding "material deviations" from approved red-line boundary footprints for residential developments within designated Conservation Areas. What spatial or linear measurement tolerance (if any) triggers an immediate Stop Notice or Enforcement Notice for an unauthorized structural footprint displacement?

2. CADSTRE / BOUNDARY MEASUREMENT ACCURACY STANDARDS: The formal equipment and data verification standards required for Planning Enforcement officers when taking site measurements. Does council policy mandate the use of high-precision geodetic or GPS total station equipment when validating layout clearances near disputed titles, or are general hand-held tape measures considered legally compliant for final enforcement site assessments?

3. INTER-DEPARTMENTAL NOTIFICATION PROTOCOLS: The internal policy or protocol governing communication between Planning Enforcement and Building Control when a structural footprint deviation is discovered. Specifically, what is the protocol when an unauthorized layout displacement directly affects adjacent domestic structures under the 3- metre and 6-metre rules defined by Section 6 of the Party Wall etc. Act 1996?

4. FOUNDATION INSPECTION ENFORCEMENT POLICIES: The council's standard enforcement criteria and statutory steps taken when a developer constructs structural walls and a roof shell over foundation trenches that bypassed mandatory local authority inspections and structural sign-offs.

Response

Answer: The service area has advised that whether a stop notice/enforcement notice are required depends on what is discovered on investigation, based on the Enforcement Policy, please see Planning supplementary enforcement policy, based on degree of ‘harm’ arising as a consequence. There is no specified measurement beyond which immediate action would be triggered.

2. CADSTRE / BOUNDARY MEASUREMENT ACCURACY STANDARDS: The formal equipment and data verification standards required for Planning Enforcement officers when taking site measurements.

Does council policy mandate the use of high-precision geodetic or GPS total station equipment when validating layout clearances near disputed titles, or are general hand-held tape measures considered legally compliant for final enforcement site assessments?

Answer: The service area has advised that there is no specified means of measuring, it depends on what is available and most appropriate for the task in hand. Using a tape, for example, has not been discredited in appeal cases.

Title disputes remain a civil matter. Part of the validation of a planning application process requires an appropriate certification to be undertaken when the application site is not in the ownership or control of the applicant.

3. INTER-DEPARTMENTAL NOTIFICATION PROTOCOLS: The internal policy or protocol governing communication between Planning Enforcement and Building Control when a structural footprint deviation is discovered. Specifically, what is the protocol when an unauthorized layout displacement directly affects adjacent domestic structures under the 3-metre and 6-metre rules defined by Section 6 of the Party Wall etc. Act 1996?

Answer: If council Building Inspectors are aware of deviations from approved planning permission, they will notify the Planning Enforcement team.

4. FOUNDATION INSPECTION ENFORCEMENT POLICIES: The council's standard enforcement criteria and statutory steps taken when a developer constructs structural walls and a roof shell over foundation trenches that bypassed mandatory local authority inspections and structural sign-offs.

Answer: The service area has advised that in circumstances where foundation excavations have been concreted without inspection by a Registered Building Inspector (RBI), or where foundations were constructed historically without appropriate inspection records, the council does not operate a prescriptive enforcement procedure that applies in every case. Each case is assessed on its individual merits, having regard to the available evidence and the level of risk presented.

The Registered Building Inspector would undertake an assessment of the works and record their findings. This would commonly include requiring trial excavations adjacent to the foundations to establish the depth, width and bearing level of the foundations and to assess the nature and suitability of the ground conditions. Where relevant, further investigations may be requested, including drainage investigations, CCTV surveys, additional excavations, structural appraisals, or other evidence necessary to establish whether the works are likely to comply with the requirements of the Building Regulations.

Where sufficient evidence cannot be provided to demonstrate compliance, the council would consider what further action is appropriate based on the circumstances of the case and the statutory powers available.
