Please send me the data you have on deaths and injuries in the road traffic environment for the calendar years 2020, 2021, 2022. These data are recorded by speed limit categories and categories of victims so please include data for 20mph/30mph/roads above 30mph and please include data for drivers and passengers of vehicles, cyclists and pedestrians.

Response

The Freedom of Information Act 2000 contains an exemption, Section 21, which states that "information which is reasonably accessible to members of the public otherwise than under Section 21 is exempt information". This means that a public authority can refuse a request because the information can be accessed already, if it is listed in the authority's Publication Scheme.

Road accident data such as that requested above is included in Herefordshire Council's Publication Scheme. Further details on how to access accident data are available on the council's website and can be viewed via the following link:

Therefore as this information is readily available to you via other means, it is exempt under Section 21 of the Freedom of Information Act 2000. Please take this letter as a refusal notice under S17 of the Act.

Please note that, before they could process your request, the Accident Investigation & Prevention team would need you to clarify what you mean by 'categories of victim'. For example are you referring to the severity of the casualties i.e. fatal / serious / slight in each collision?
