CLARIFICATION: I am interested in staff who happen to be trade union reps but the misconduct is not related to their union activities.
1) Since the 2022 financial year, how many cases of misconduct have there been by trade union reps?
2) What is your policy in dealing with misconduct by trade union reps?
3) Is the data you are supplying for all misconduct cases, or those which are formerly recorded?

CLARIFICATION: I am interested in staff who happen to be trade union reps but the misconduct is not related to their union activities.
1) Since the 2022 financial year, how many cases of misconduct have there been by trade union reps?
Answer: The Service Area have advised the number of cases of misconduct by trade union reps that can be identified is 2. However, the Service Area have also advised they do not actively record if an employee is a trade union rep when they have a misconduct case, as it is in relation to their actions in their normal duties. As such, there may be more cases which have not recorded that the employee is a trade union rep.
2) What is your policy in dealing with misconduct by trade union reps?
Answer: The Service Area have advised we do not have a specific policy for dealing with misconduct for employees who happen to be trade union reps, as they would be treated the same as any other employee and so would follow the normal Behaviour Policy process, a copy of which is attached.
3) Is the data you are supplying for all misconduct cases, or those which are formerly recorded?
Answer: The Service Area have confirmed the information provided is for formal misconduct cases.
