An unauthorised diversion of a public highway occurred in or around the 2000s without due process, at Quebb Cottages on the U90617.

It was claimed to the Ward Member the road was to be restored to its lawful routing as part of a planning application.

Please provide any requests, Notices, Orders, etc from HC to the landholders,  and any letters from the landholders agreeing to do this, and by what date.

Answer: We consider this information to be excepted under Regulation 12 (5) (b) of the Environmental Information Regulations 2004 because disclosure would adversely affect the course of justice.

This exception is subject to a public interest test and accordingly I have weighed up the reasons for and against disclosure in the public interest as follows:

The public interest in disclosure:

Openness and transparency in decision making; release would demonstrate the council's thinking regarding this matter.

The public interest in not disclosing the information:

The matter in question is the subject of ongoing court proceedings, which are still live at the time of writing.

Disclosure under the Environmental Information Regulations is essentially a disclosure to the world at large not just to the individual who requested it. If the requested information were to be disclosed to the world at large, at this stage during ongoing proceedings, this would be prejudicial to those matters.

Taking the above into account, I find the balance in non-disclosure of the information to outweigh the public interest in disclosure.
