CLARIFICATION 1

1. Older people, as classified and confirmed to be your categorisation. From what you have said, I would presume that Herefordshire consider older people to be 65 and over.

2. In relation to (5)(1) "against" should be interpreted as against the alleged perpetrator.

3. In relation to (5)(2) - per (5)(1) and in the context more widely provided.

4. Section 7 relates to MCA (Mental Capacity Act) assessments conducted after a safeguarding referral has been made, during a safeguarding investigation or associated with the safeguarding referral - for example as part of the conclusions of the investigation and where the subject of the MCA is the purported victim of abuse/harm.

5. In relation to 8(1) - In a wider capacity (not just in relation to safeguarding), does Herefordshire Social Care receive funding beyond the cost of placing a person in alternative accommodation from that which they were in before Social care became involved that subsequently increases the Social care budget or any other budget of Herefordshire County Council.

In relation to 8(2) - Does Herefordshire Social Care consider that a council arranged accommodation placement (per 8(1)), outside of that which was arranged prior to Social Care's involvement (for example by/with family) would both cost less and be more beneficial when considering budgetary constraints given that supporting a person to live independently or with family can be more costly?

As the fundamental aims and objectives are the same - to protect the vulnerable in all age groups, I collectively use the term “Safeguarding” to cover children, disabled and/or otherwise vulnerable adults and older people to reflect the overall subdivisions of Social Care.

A)   The information for Section 7, questions 2-7, Section 9, questions 1-3, and Section 10, questions 2-8, is not held in a form that would enable it to be located, retrieved and extracted within the Appropriate Time Limit which equates to 18 hours as defined by the Freedom of Information and Data Protection (Appropriate Limits and Fees) Regulations 2004.

Our electronic reporting systems are unable to run a report for this information. To ascertain the data requested, officers would need to manually check individual files for this information. An initial search has shown that 10,000 Adult Social Care files and 6,400 Children’s Social Care files would need to be checked for this information, and it is estimated that it would take 15 minutes to check each file. Once the details had been identified this would need to be noted and once all files had been checked in this way, the total figures requested could be calculated.

This would at a conservative estimate take at least 4,100 hours to complete. Where the Limit is exceeded Public Authorities are not obliged to supply the information requested by virtue of S12 of the Act. Please take this letter as a refusal notice under S17 of the Act.
