LADO Referral Outcome Appeals

Request

1. Details of your process and procedures for individuals who wish to appeal a LADO referral outcome made against them.

2. A name, email, and postal address of the individual ultimately responsible for assessing appeals and reviewing how safeguarding cases have been handled by local authority personnel and agencies.

3. The total number of appeals submitted to Herefordshire Council, related to LADO referrals, over the last five years, and the percentage of appeals that were successful. If you do not have an appeals process, could you please provide:

4. A statement to justify why this process doesn't exist, including how Herefordshire Council is remaining compliant with the Human Rights Act (specifically articles 6, 7, and 8).

1. Details of your process and procedures for individuals who wish to appeal a LADO referral outcome made against them.

There is no appeal to the outcome of the Safeguarding LADO Process. This is a multi-agency process with no right to appeal or attend professionals meetings. The Herefordshire Council complaints process should be followed if a person considers the procedures/processes were not followed.

Zero, there is no right to appeal.

4. A statement to justify why this process doesn't exist, including how Herefordshire Council is remaining compliant with the Human Rights Act (specifically articles 6, 7, and 8).

There is no formal appeals process to challenge a decision made by the LADO. They are considered independent and will have the right to make decisions based on multi-agency investigations. Therefore the appeal should be made against the employers or agency undertaking the inquiries. LADO have no powers or jurisdiction to suspend or terminate employment.
