FOI release

Number of applicants with planning permission for one type of building who reapply for something else

Case reference FOI2023/01378

Published 2 October 2023

Request

I would like to know how many applicants get planning permission for one type of building and then reapply for something else instead. Please provide figures for the past five years (no preference over financial or calendar years) We have had a number of planning decisions approved in our local area for a small cottage In keeping with the character of the area but then the applicant has reapplied for enormous unsuitable building instead and it seems to be waived through.

Response

A: Applications where approval is granted for one design and then application is made to change it are called Section 73 Variation of conditions. The service area have advised that they haven't give figures for all section 73's but narrowed it down to condition 2 which deals with amended plans, so below are the figures from 2018 to 2023 for Section 73's where the design has been changed on dwellings.

2018: 64, 2019:76, 2020:41, 2021:37, 2022: 22, 2023:4 up until 22/08/23

If you wish to narrow down the search to your parish area, you can search by application type S73 and search by your Parish on the planning portal by typing in 'Variation of conditions' which would bring up all variation of condition applications which relates to change of plans. If you wish to view all those in your parish, you can select 'Search by Map. Where you can then display your parish and view the relevant applications. A link to the planning portal is below:
