Response

1. How many incidents of anti-social behaviour were reported in 2022/23 where any social housing tenants were the alleged perpetrators? Please advise both by number of incidents and by number of households accused of being responsible for at least one incident.

Please note that the number of households are not recorded because any incidents of anti-social behaviour are recorded against the property. In 2022/23 there were 249 reports of anti-social behaviour type incidents from social housing properties.

2. How many of the above incidents resulted in any penalty being imposed?

3. How many of the above incidents resulted in any warning being issued?

4. How many evictions for anti-social behaviour took place from 2022/23?

The information requested in Questions 2-4 is not held in a form that would enable it to be located, retrieved and extracted within the Appropriate Time Limit which equates to 18 hours as defined by the Freedom of Information and Data Protection (Appropriate Limits and Fees) Regulations 2004.

We are unable to run a report from our electronic systems for this data. To ascertain the information requested officers would need to manually check the record of each incident to see whether any penalty was imposed, whether the incident resulted in a warning being issued, or, whether an eviction took place as a result of anti-social behaviour. As explained above, there were 249 reports of anti-social behaviour type incidents from social housing properties during 2022/23. It took officers 4 hours to establish the number of relevant cases for Question 1, and it is estimated that it would take at least 5 minutes to check each file for the information requested in Questions 2-4.

This would at a conservative estimate take at least 20.75 hours to complete. Where the Limit is exceeded Public Authorities are not obliged to supply the information requested by virtue of S12 of the Act. Please take this letter as a refusal notice under S17 of the Act for this part of your request.

If you wish to discuss ways in which your request could be narrowed down in scope to take it under the 18 hour limit, please let us know.
