Request

1. Therefore would you please provide any other “reports” written (or contributed to) by the Enforcement Officer on any carriageways or byways or restricted byways, or bridleways.

2. Please detail any relevant qualifications held by the author.

3. Please advise who authorised the reports to be created, when and for what purpose.

4. Have any decisions been made or influenced, based on these reports?

Response

A: This information is not held in a form that would enable it to be located, retrieved and extracted within the Appropriate Time Limit which equates to 18 hours as defined by the Freedom of Information and Data Protection (Appropriate Limits and Fees) Regulations 2004.

 

Our electronic reporting systems are unable to generate reports by author. To ascertain the data requested officers would need to manually check files/individual reports for this information. An initial search has shown that at least 804 reports would need to be checked, which may or may not have received a contribution from the relevant officer. Officers would need to go into every report to check the details and investigate the system log details for many others. Each report would take approximately 5 minutes to read and establish whether it has been written by or had contribution from the officer in question.

 

This would at a conservative estimate take at least 67 hours to complete. Where the Limit is exceeded Public Authorities are not obliged to supply the information requested by virtue of S12 of the Act. Please take this letter as a refusal notice under S17 of the Act.

 

Officers have advised they could answer Questions 1, 3 and 4 within the limit, please let me know if you’d like this.
