Please provide the Executive Summary of the Report HC asked Robin Carr Associates to prepare regarding the inclusion of U75235 in the List of Streets.

Response

The information requested is withheld under Section 36 (2) (c) of the Freedom of Information Act 2000 because disclosure would be likely to prejudice the effective conduct of public affairs.

This exemption is subject to a public interest test and accordingly we have weighed the reasons for and against disclosure in the public interest as follows:

The public interest in disclosure:

Openness and transparency regarding the highway in question, which will help the public to understand the council's decision making regarding it.

The public interest in non-disclosure:

If the requested information were released into the public domain (which disclosure under the Freedom of Information Act would essentially do) at this stage, it would be likely to disrupt the review of the report which is currently taking place. The report, which the council asked the third party consultant to prepare, is currently being reviewed by the Public Rights of Way and Legal teams, and is being shared with other relevant parties. This will help them to determine next steps. If the report were disclosed before this process was finalised it would be pre-emptive, and, would be likely to put any decision making at risk if disclosed before a proper review had been completed.

Taking the above into consideration, I find the balance of non-disclosure of the information to be in the public interest. Please take this letter as a refusal notice under S17 of the Act for this part of your request.
