I am requesting all information from 2010 to present regarding the environmental health concerns, noise nuisance and licence suitability regarding Out to Grass both internal and external.
A. Herefordshire Council holds information on Out to Grass from 2010 to present day. This information is held by the Environmental Health teams.
Upon conducting an initial search of our database for records dating back to 2010, the Service Area identified 62 records related to noise nuisance and license issues from this address to various Environmental Health teams. Assessing and extracting all information relevant to this FOI request is estimated to take at least 40 minutes on average for each service request. With 62 service requests, this translates to approximately 41 hours.
Additionally, further time will be required to retrieve, check, and redact personal information on each document or data record retrieved. The time needed for this step will depend on the complexity and volume of the documents which will vary greatly. Given the extensive data likely to be present in several of the records for this premises, the total time required could be substantial.
Under the Environmental Information Regulations 2004, public authorities can make a ‘reasonable’ charge for staff time and costs in such requests. Due to the complexity and volume of the information which needs to be searched through, there will be a fee payable for this information to be retrieved, collated and provided to you. The fee is in accordance with Regulation 8 of the Environmental Information Regulations 2004, and with our information requests charging policy.
The Information Commissioner’s Office suggests that public authorities use a rate of £25 per hour for any staff time involved. This in line with the rate applicable under the Freedom of Information Act by virtue of The Freedom of Information and Data Protection (Appropriate Limits and Fees) Regulations 2004.
The fee payable is £1,025.00
This has been calculated as follows:
Officer time to retrieve, collate and provide information at rate of £25 per hour (41 hours @ £25 per hour) = £1,025

You have 60 working days in which to pay this fee. The information will be sent to you following receipt of this fee and the work being carried out as specified above. If remittance is not received during this time we will consider the request closed.

The information will still need to be checked to see whether any exceptions apply, for example, whether any information is the personal data of a third party, or whether any is commercially sensitive, etc. If it is considered that any exceptions do apply, then this information may be withheld in part or in its entirety. For example, just letters which were sent to the venue regarding any complaints received in the last 10 years.
