Answer: This information is not held. The Service Area have advised our Housing Services has no legal duty to provide accommodation for Asylum Seekers and as such does not provide them with accommodation.

 

We provide routes into accommodation through Part VII (homelessness assistance) and Part VI (Housing Register – which in Herefordshire is known as Home Point) of the Housing Act 1996. To access accommodation services provided under the above legislation an applicant must be eligible for public funds. Asylum Seekers by their very nature are excluded from public funds. If they are given a positive decision on their application for asylum then they become eligible for public funds and are no longer Asylum Seekers.

 

Any accommodation provided by the council or sourced by the council for asylum seekers is likely to be done either on behalf of the Home Office who hold the duty to accommodate adult Asylum Seekers and Asylum Seekers with children. In addition there is a duty on Children’s Services under Section 20 of the Children Act 1989 to accommodate unaccompanied children seeking asylum.
